Disturbance in Deep Ellum

A warrant was issued today for L’Daijohnique Lee.  Ms. Lee is being charged with Criminal Mischief, State Jail Felony.  These charges stem from the Deep Ellum incident that occurred on March 21, 2019.  After Ms. Lee was assaulted, she broke out the windows of a vehicle belonging to Mr. Austin Shuffield.  Based on the damages to the window, witness testimony, and Ms. Lee’s own admission, responding officers filed a criminal mischief report at the time of the incident.  An actual dollar amount of damages could not be ascertained at the time the offense occurred.  Mr. Shuffield’s vehicle was towed to the city pound for protective custody after his initial arrest. On Tuesday, March 26, Mr. Shuffield was interviewed and verified the facts of this offense.

On Monday, April 1, 2019, Mr. Shuffield subsequently provided detectives with an estimate of $3,010.88 to repair his vehicle. On Tuesday, April 2, 2019, detectives verified the amount and according to section 28.03 of the Texas Penal Code, if the dollar amount is more than $2,500 but less than $30K, the appropriate charge is Criminal Mischief SJ/F.  Ms. Lee has not been arrested at this time. 

 

Update March 28, 2019 at 11:00 a.m.

The Dallas Police Department has concluded its investigation into the assault that occurred in Deep Ellum on March 21, 2019.  The officers at the scene arrested Austin Shuffield for Public Intoxication, Interference with an Emergency Call and Assault.  Each of these offenses are a Class “A” Misdemeanor except for the Public Intoxication charge which is a Class “C” Misdemeanor.  Upon further investigation by the Crimes Against Persons Division an additional charge of Unlawfully Carrying of a Weapon has been filed and a charge of Aggravated Assault with a Deadly Weapon, which is a second-degree felony, has been sent to the Dallas District Attorney’s Office for presentation to the Grand Jury.

The Dallas Police Department is investigating a physical altercation that occurred recently in Deep Ellum. This physical altercation was filmed and the video subsequently circulated around the country.

The Dallas Police Department shares in the sentiment that the altercation captured on camera is deeply disturbing. Based on the initial evidence gathered by responding officers, the man was immediately arrested and charged with Assault-Bodily Injury and Interfering with an Emergency Call, both are Misdemeanors.

This is still an ongoing investigation and it is imperative that we are thorough and deliberate. Detectives in this case are still interviewing witnesses and collecting evidence and will determine what if any additional charges should be filed. This offense is documented on Case Number 056082-2019.
